(“we” or “us”) provides the ARSENAL Soccer Camps (the “ARSENAL Soccer Camp”) described in the accompanying brochure. These terms and conditions apply to the ARSENAL Soccer Camp named on the Guest Reservation and Payment Form (the “ARSENAL Soccer Camp”) and the program for this ARSENAL Soccer Camp.
To reserve a space for ARSENAL Soccer Camp, you must submit a completed payment fee per participant, depending on the program chosen (unless we note otherwise in writing), and complete the Registration Form (“Registration Form”) as part of this Participant Agreement. All prices are in U.S. Dollars. You must cover any ARSENAL Soccer Camp-related costs you incur, except as expressly stated in the brochure.
If you choose to cancel your registration, we must receive written notice of said cancellation either via certified mail, overnight courier, or e-mail sent to info@arsenalsoccercampsus.com (with confirmation of receipt from us), and you shall be subject to the following cancellation fee:
If we receive a written notice prior 60 days of the camp date, the organization will retain $95.00 as a compensation for the registration expenses.
If we receive a written notice between 60-30 days of the camp date, the organization will retain 50% of the payment fee paid.
If you send us a written notice of cancellation within 30 days of the camp date, we will not refund the amount paid for the Arsenal Soccer Camps.
If the participant does not show up to the camp, we will not refund the amount paid.
Cancellation or Substitution: We may cancel any ARSENAL Soccer Camp at any time for any reason, including without limitation if we deem the number of participants signed up for a given ARSENAL Soccer Camp to be insufficient to operate such ARSENAL Soccer Camp. The current location may change to a different one within a 25-mile radius due to factors beyond our control. While we make commercially reasonable efforts to maintain the published schedule and location, the final schedule may vary due to factors beyond our control. At our sole discretion, the provider may substitute services or goods of similar quality for any service or good listed in the schedule.
If we cancel the ARSENAL Soccer Camp, our liability is limited to issuing a full refund of your deposit and the ARSENAL Soccer Camp price. We do not assume liability for any other costs, damages, or refunds related to loss, delay, inconvenience, disappointment, or expenses under these circumstances.
If circumstances beyond our control require us to interrupt or cancel an ARSENAL Soccer Camp already in progress, we will, in good faith, consider refunding a portion of the camp price based on the actual costs incurred compared to the camp as originally planned.
Certification of Participant’s Health; Responsibility to Inform Operator of Disabilities or Pregnancy: By signing below and/or tendering any portion of the ARSENAL Soccer Camp Price to us, you certify that you do not have any condition or disability that would create a hazard for you or others participating in the ARSENAL Soccer Camp.
You agree to inform us via certified mail or e-mail sent to info@arsenalsoccercampsus.com (with confirmation of receipt thereof from us) at the time you tender your first payment of the ARSENAL Soccer Camp Fee (or at such later time when you become aware of such a condition) of any existing physical or mental illness, disability, pregnancy or any other condition for which you may require medical attention or special accommodation during the ARSENAL Soccer Camp.
We make no guarantee to be able to accommodate you for such condition during the ARSENAL Soccer Camp, and we make no representations or warranties regarding special accommodations or handicap accessibility on the ARSENAL Soccer Camp.
Athletics Release: You hereby acknowledge that playing or practicing soccer is a potentially hazardous activity.
You voluntarily choose to participate in these activities and knowingly assume all associated risks. These risks include, but are not limited to, falls, contact with other participants, weather conditions such as heat or humidity, and the condition of training grounds and facilities. You fully understand and accept all of these risks. By reading this waiver, acknowledging these facts, and in consideration of Arsenal Soccer Camps accepting your application, you waive and release Arsenal Soccer Camps and its representatives from any and all claims or liabilities arising from your participation in soccer activities, including playing, practicing, or training.
Responsibility/Liabilities: We act only in the capacity of agent for providing services or goods in connection with the ARSENAL Soccer Camp (the Suppliers”), camp operators, and providers of entertainment. We do not assume responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity. This includes any issues caused by (1) the acts or omissions of any suppliers, or (2) matters beyond our exclusive control, such as flight delays or cancellations that cause you to miss any portion of the ARSENAL Soccer Camp.
We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at the camp locations. You are also responsible for respecting the authority and following the directions of the ARSENAL Soccer Camp guide during a ARSENAL Soccer Camp.
We may exclude you from participating in all or any part of the ARSENAL Soccer Camp if, in our sole discretion, your condition or behaviour renders you unfit for the ARSENAL Soccer Camp or unfit for continuation once the ARSENAL Soccer Camp has begun. Unfitness may include, without limitation, any behaviour that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of ARSENAL Soccer Camp services, or may constitute a hazard or embarrassment. In such cases, we limit our liability strictly to refunding the recoverable cost of any unused portion of the ARSENAL Soccer Camp.
Should you decide not to participate in certain parts of the ARSENAL Soccer Camp or use certain goods included in the ARSENAL Soccer Camp, no refunds will be made for those unused parts of the ARSENAL Soccer Camp or goods. You agree to indemnify and hold us harmless from and against any costs, damages, losses, or liabilities arising out of your actions or omissions.
General: Any dispute related to the ARSENAL Soccer Camp shall be governed by Florida law without regard to conflict of laws principles. The federal or state courts in Dade County, Florida shall be the exclusive forum for any lawsuit related to the ARSENAL Soccer Camp, and you consent to the personal jurisdiction by said courts.
You agree to present any claims against us within 30 days after the ARSENAL Soccer Camp ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. We will treat any signed document sent by facsimile as if you delivered the original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Participant Agreement, the Reservation Form, and the Itinerary, this Participant Agreement shall apply.
Image Rights:
Arsenal Soccer Camps and its related entities request your consent to record and use the image of the registered child, in accordance with Article 18.1 of the Constitution, Organic Law 1/1982 on the right to honor and personal and family privacy, and Organic Law 15/1999 on Personal Data Protection.
Arsenal Soccer Camps may take photographs and recordings during ARSENAL Clinic and ARSENAL Soccer Camp activities, in which the child may appear clearly identifiable. The camps and their partners may then publicly display these materials through various media channels, solely to promote the project and its social objectives.
You grant this consent and authorization free of charge and formally waive any right to economic compensation.
We remind you that in order to exercise the rights of access, rectification, cancellation and opposition contemplated in the law you can communicate with Arsenal Soccer Camps by email at: info@arsenalsoccercampsus.com. I declare that I have the legal powers to grant this authorization on the use of the image of the indicated minor.
I, the undersigned, as parent or guardian, give my consent for our camper, identified herein, to participate in soccer activities during the summer camp program. I acknowledge and accept that I participate in any soccer event at my own risk. I will not hold Arsenal Soccer Camps., its officers, agents, employees, or anyone acting in its behalf, responsible or liable for injury occurring to the named camper in the course of such activities or such travel.
I understand that Arsenal Soccer Camps will complete the required accident insurance forms, and that my camper, I, or my guardian(s) must submit any claims for injuries sustained during summer program activities and events directly to the insurance company. Arsenal Soccer Camps will not process these claims.
I hereby accept financial responsibility for personal items lost by the camper identified herein.
I authorize Arsenal Soccer Camps to transport and to obtain, through a physician of its own choice, any emergency medical care that may become reasonably necessary for the camper in the course of such activities/events or such travel. I also agree that the expenses for such transportation and treatment shall not be borne by Arsenal Soccer Camps. I accept full responsibility and hereby grant permission for my son/daughter to travel on any camp-related trip by bus or van.
In consideration of my participation, or the participation of my minor child(ren) or ward(s), in any Arsenal Soccer Camps–related events and activities, I, as the participant, parent, or legal guardian, acknowledge, understand, and agree to the following:
By participating in Arsenal Soccer Camps–related events and activities, I understand that these activities involve inherent risks, including the risk of exposure to communicable diseases. These risks include, without limitation, exposure to the virus known as severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), which causes Coronavirus Disease (COVID-19), as well as any mutation or variation thereof (collectively, “Communicable Diseases”).
I acknowledge that I fully understand the hazards associated with Communicable Diseases. I knowingly and voluntarily assume full responsibility for any risk of illness, personal injury, disability, death, or other loss that I or my minor child(ren) or ward(s) may suffer in connection with exposure to Communicable Diseases.
On behalf of myself and/or my minor child(ren) or ward(s), and on behalf of our heirs, assigns, beneficiaries, executors, administrators, personal representatives, and next of kin, I expressly release, hold harmless, and forever discharge Arsenal Soccer Camps and its officers, officials, agents, representatives, employees, sponsors, advertisers, other participants, and, when applicable, the owners and lessors of the premises where Arsenal Soccer Camps–related activities take place (collectively, the “Released Parties”).
I release the Released Parties from any and all claims, demands, actions, causes of action, losses, or liabilities of any kind, whether in law or equity, that arise out of or relate to any illness, injury, disability, death, or other damages that I or my minor child(ren) or ward(s) incur due to or in connection with Communicable Diseases, including claims based on the negligence of the Released Parties, to the fullest extent permitted by law.
I agree that the laws of the State of Florida govern this Agreement. I also agree that this Agreement intends to remain as broad and inclusive as Florida law allows. If a court finds any provision of this Agreement invalid or unenforceable, the remaining provisions shall continue in full force and effect.
I confirm that I have read this Release of Liability and Assumption of Risk Agreement, that I fully understand its terms, that I understand I am giving up substantial legal rights, and that I accept this Agreement freely and voluntarily without any inducement.
Students shall not carry or posses a firearm, knife, weapon, or an item which can be used as a weapon. Notice is hereby given that possession of a firearm, a knife, a weapon, or an item, which can be used as a weapon, is grounds for expulsion from the remaining of the summer program. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the summer program will not be reimbursed.
Any camper who possesses or sells controlled substances, as defined in Chapter 893 of the Florida Statutes, will be expelled from the summer program.
If a student possesses, uses, or remains under the influence of alcoholic beverages, hallucinogenic drugs, marijuana, glue, drug paraphernalia, or any combination of drugs or substances with hallucinatory effects—including substances prohibited by federal, state, or local laws, or substances represented as controlled, illegal, or counterfeit—the program will expel the student for the remainder of the summer session and refer the case to the appropriate law enforcement authorities.
The program will immediately notify the parent(s) or guardian(s) and require them to pick up the camper. The program will not reimburse any fees paid for the summer program.
The program will expel any camper who possesses prescription drugs or over-the-counter medication without specific authorization from a physician, parent, or guardian.
