PARTICIPANT AGREEMENT

ARSENAL SOCCER CAMPS USA

This Participant Agreement (“Agreement”) is entered into between Soccer Camps Pro Inc., a corporation organized under the laws of the State of Florida and operating soccer camps throughout the United States (“Soccer Camps Pro”, “Company”, “we”, “our”, or “us”), and the parent, legal guardian, or participant identified in the registration form (“Participant”, “you”, or “your”).

Soccer Camps Pro Inc. operates Arsenal Soccer Camps in the United States through the website arsenalsoccercampsus.com.

By registering for any Arsenal Soccer Camp operated by Soccer Camps Pro Inc. in the United States, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.

Arsenal Soccer Camps are day camp soccer programs for children ages 6 through 14.


1. REGISTRATION AND PAYMENT

A completed registration form and payment of the applicable registration fees are required to reserve a place in the camp.

All fees are stated in United States Dollars (USD).

Except as expressly stated herein, participants are solely responsible for all personal expenses related to participation in the camp.

By registering, you also acknowledge and agree to the applicable Privacy Policy, Legal Notice, and Cookies Policy available on arsenalsoccampsus.com.

Electronic signatures, online acknowledgments, and digital acceptances of this Agreement shall have the same legal force and effect as original handwritten signatures.


2. CANCELLATION AND REFUND POLICY

All cancellation requests must be submitted in writing by email to info@arsenalsoccercampsus.com.

Refunds shall apply as follows:

  • More than sixty (60) days prior to the camp start date:
    Refund of all amounts paid less a USD $95 administrative fee.
  • Between sixty (60) and thirty (30) days prior to the camp start date:
    Refund of fifty percent (50%) of the total amount paid.
  • Less than thirty (30) days prior to the camp start date:
    No refunds shall be issued.
  • No refunds shall be issued for participants who fail to attend the camp without prior written cancellation notice.

Refund requests are processed within a commercially reasonable period of time.


3. CAMP CANCELLATION, MODIFICATION, OR SUBSTITUTION

Soccer Camps Pro Inc. reserves the right to cancel, postpone, modify, or reschedule any camp for any reason, including but not limited to insufficient enrollment, facility availability issues, weather conditions, safety concerns, governmental restrictions, or other events beyond our reasonable control.

We may also relocate the camp venue to another suitable location within a twenty-five (25) mile radius when reasonably necessary.

We will make commercially reasonable efforts to maintain the published schedule, staffing, and programming; however, schedules, coaches, activities, facilities, and services may change without prior notice.

If a camp is canceled prior to its commencement by Soccer Camps Pro Inc., our liability shall be limited solely to a refund of amounts paid for the canceled camp.

Under no circumstances shall Soccer Camps Pro Inc. be responsible for airfare, hotel costs, transportation expenses, loss of profits, consequential damages, incidental damages, or any other indirect expenses or losses incurred by participants or their families.

If a camp is interrupted or terminated after it has commenced due to circumstances beyond our reasonable control, any refund shall be determined by Soccer Camps Pro Inc. in good faith based on the unused portion of the camp and actual expenses incurred.


4. FORCE MAJEURE

Soccer Camps Pro Inc. shall not be liable for any delay, cancellation, interruption, modification, or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, severe weather, natural disasters, epidemics, pandemics, communicable disease outbreaks, governmental actions, war, terrorism, civil unrest, labor shortages, transportation interruptions, facility closures, utility failures, or any other force majeure event.


5. HEALTH CERTIFICATION AND MEDICAL DISCLOSURE

By registering the participant, you certify that the participant is physically and mentally able to safely participate in camp activities.

You agree to disclose prior to the start of camp any medical, physical, psychological, behavioral, or other condition requiring supervision, accommodation, medication, or medical attention.

You further authorize Soccer Camps Pro Inc. to provide or arrange emergency medical treatment if deemed reasonably necessary by camp personnel.

You understand and agree that all medical costs, transportation expenses, and related healthcare expenses shall be the sole responsibility of the participant and/or parent or legal guardian.

Soccer Camps Pro Inc. does not guarantee the availability of specific medical services, accommodations, or accessibility features at every camp location.


6. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

You acknowledge that participation in soccer training, athletic activities, and camp-related programs involves inherent risks, including but not limited to:

  • falls,
  • collisions,
  • physical contact with other participants,
  • equipment-related injuries,
  • weather-related conditions,
  • heat-related illness,
  • transportation-related risks,
  • and other known and unknown risks that may result in injury, illness, permanent disability, or death.

You voluntarily assume all risks associated with participation in camp activities.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS SOCCER CAMPS PRO INC., ARSENAL SOCCER CAMPS, ARSENAL FOOTBALL CLUB, THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, COACHES, CONTRACTORS, FACILITY OWNERS, SPONSORS, LICENSEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR EXPENSES ARISING OUT OF OR RELATED TO PARTICIPATION IN CAMP ACTIVITIES, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE.

This release shall apply to the fullest extent permitted under applicable law.


7. COMMUNICABLE DISEASE ASSUMPTION OF RISK

Participant may be exposed to communicable illnesses, viruses, bacteria, or infectious diseases, including but not limited to COVID-19, influenza, or other contagious conditions.

You voluntarily assume all risks associated with exposure to communicable diseases arising from participation in camp activities.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE AND HOLD HARMLESS SOCCER CAMPS PRO INC. AND ALL RELATED PARTIES FROM ANY CLAIM ARISING OUT OF EXPOSURE TO COMMUNICABLE DISEASES, INCLUDING CLAIMS BASED ON ORDINARY NEGLIGENCE.


8. PARENTAL AUTHORIZATION AND EMERGENCY MEDICAL CARE

As parent or legal guardian, you authorize the participant to engage in all camp activities and authorize Soccer Camps Pro Inc. to obtain emergency medical treatment for the participant when deemed reasonably necessary.

You authorize transportation of the participant by ambulance, emergency vehicle, bus, van, or other transportation method if necessary.

You acknowledge that Soccer Camps Pro Inc. does not provide health insurance coverage for participants.

Any insurance claims shall be processed through the participant’s personal insurance provider.


9. CODE OF CONDUCT

Participants are expected to behave respectfully and safely at all times.

Soccer Camps Pro Inc. reserves the right to remove or dismiss any participant whose conduct is deemed unsafe, disruptive, abusive, violent, discriminatory, inappropriate, illegal, or detrimental to the camp environment.

No refunds shall be issued for dismissals related to participant misconduct.


10. WEAPONS POLICY

Participants shall not possess or carry firearms, knives, weapons, explosives, or any item that may reasonably be considered dangerous.

Violation of this policy may result in immediate dismissal from camp without refund and notification of law enforcement authorities where appropriate.


11. ILLEGAL SUBSTANCES AND MEDICATION POLICY

Possession, use, sale, distribution, or being under the influence of illegal drugs, alcohol, controlled substances, vaping products, tobacco products, or drug paraphernalia is strictly prohibited.

Prescription medications must be disclosed in advance and administered in accordance with camp policies and parental instructions.

Violation of this policy may result in immediate dismissal from camp without refund and possible notification of law enforcement authorities.


12. MEDIA RELEASE AUTHORIZATION

By registering the participant, you grant Soccer Camps Pro Inc., Arsenal Soccer Camps, Arsenal Football Club, their affiliates, sponsors, partners, licensees, and authorized representatives the irrevocable right and permission to photograph, record, film, livestream, and otherwise capture the participant’s name, image, voice, likeness, and appearance during camp activities.

You authorize the use of such materials worldwide, in perpetuity, in any format or media now known or later developed, including but not limited to websites, social media, advertising, promotional materials, broadcasts, publications, and marketing campaigns, without compensation or further approval.

All such materials shall remain the sole property of Soccer Camps Pro Inc. and/or its partners.

If you do not wish for the participant’s image to be used, you must notify us in writing prior to the start of camp at info@arsenalsoccercampsus.com.


13. DISCLAIMER REGARDING ARSENAL FOOTBALL CLUB

Arsenal Football Club is not the operator of the camps in the United States.

The camps are independently owned and operated by Soccer Camps Pro Inc. under license and authorization.


14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles.


15. ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

Any dispute, claim, or controversy arising out of or relating to this Agreement or participation in any camp shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) in the State of Florida.

You waive any right to participate in a class action lawsuit, class arbitration, or representative action.

Each claim must be brought solely in the individual capacity of the claimant.


16. LIMITATION PERIOD

You agree that any claim against Soccer Camps Pro Inc. must be submitted in writing within thirty (30) days following the end of the applicable camp session.

Any legal or arbitration proceeding must be commenced within one (1) year after the event giving rise to the claim occurred, or such claim shall be permanently barred to the fullest extent permitted by law.


17. SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.


18. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties relating to participation in Arsenal Soccer Camps and supersedes any prior oral or written communications.

In the event of any conflict between this Agreement, registration materials, brochures, or promotional materials, this Agreement shall control.
